\nGeneral Terms and Conditions of Business
\n1. Scope
\nOur online shop is intended exclusively for businesses (B2B). In addition to verifying your business status during the order process, we are entitled to request suitable, current evidence of your business status (e.g. a commercial register extract or trade registration). These terms also apply to future business relationships without our having to refer to them again. Any conflicting or supplementary terms used by the customer are hereby rejected and become part of the contract only with our express consent.
\n2. Contracting party & conclusion of contract
\nThe purchase contract is concluded with Gustivo GmbH. The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. By clicking the order button you submit a binding offer; the contract is formed when we accept it through an order confirmation or by dispatching the goods.
\n3. Prices & shipping costs
\nAll prices are net prices plus statutory VAT. Shipping costs are shown transparently in the basket and at checkout (see our Shipping & Delivery page).
\n4. Payment & delivery
\nThe payment methods available to you are shown during checkout. Delivery is made to the address you provide, via the carrier best suited to the goods.
\n5. Retention of title
\nThe goods remain our property until payment has been received in full.
\n6. Inspection & notice of defects (merchants)
\nAs the contract is a commercial transaction for both parties, the customer’s duties to inspect the goods and give notice of defects under § 377 of the German Commercial Code (HGB) apply.
\n7. Warranty & liability
\nStatutory warranty rights apply. Our liability is limited in accordance with the statutory provisions; this does not affect liability for injury to life, body or health, or for intent and gross negligence.
\n8. Governing law & jurisdiction
\nGerman law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is our registered office, to the extent permitted by law.
